One of the more difficult aspects of the vape industry is that, being a relatively new industry, certain rules and laws are still being developed in most states. Consider the following headlines:
“California e-cigarette bill abandoned after hostile amendment.”
“NY fines liquid nicotine makers for not childproofing package.”
“Alarmed at rising teen e-cigarette use, Hawaii raises smoking age to 21.”
“Utah laws taking effect include rules on e-cigarette sales…”
“New Delaware legislation bans e-cigarettes indoors.”
“States to start cracking down on e-cigarette sales to minors.”
These are just samplings of recent headlines that have come out in regards to the vape industry. As case laws develop, and statutes are created, these court rulings could have a dramatic effect on the vape industry and your business. And as laws are passed, and whether you agree with them or not, it is important to understand and comply with them. Disregarding the law could cost your business thousands of dollars and even potentially shut your business down. Don’t let this happen to you.
The following are some suggestions to help you understand, follow, and comply with the specific vape laws in your state:
Stay informed. It is important to understand what laws have been passed – or new ones that are being created – that will affect your industry. Sign up for newsletters, attend state sessions, etc., because it is important to know what is happening within your state and industry.
Get Involved. You have a voice! If your state is considering new laws that may affect your business, speak up. This is not the time to be shy…share your opinion, take the opportunity to speak to your lawmakers. It may, or may not, make a difference but it is worth trying.
Follow the law. Once a law has been passed, and whether you agree with it or not, it is your responsibility to follow the law. Remember, ignorance of the law is not a valid excuse, and civil disobedience, while sometimes admirable, will still lead to fines and possibly the loss of your business.
Educate. Educate your customers and peers of any current or new laws in your industry. In Utah, where VIP is based, a law was passed a few years ago that added e-cigarettes to the Clean Air Act. This means that, like regular cigarette users, individuals cannot vape within 25 feet of a building entrance. Your customers need to know the laws of the state where you are based, and you are in a good position to help educate them.
Because every state is passing new (and different) laws all the time, it might only be a matter of time before a sweeping federal law is passed as well. Whether it is a local, state, or federal law, it is a good idea for you to know exactly what is happening when it comes to the law and your business.
